Terms & Conditions of Hire

 

1. This hire agreement is made between Fife Holiday Homes (“us/we”) and the person paying the deposit (“you”) for the hire of cottages shown on the website (“the property”).

 

2. The period of hire is from 4pm on the day of arrival until 10am on the day of departure; you and all members of your party must vacate the property by then unless otherwise agreed with Lyn

 

3. The property shall be used solely for the purposes of a holiday and you shall not sub-let the property or any part of it or any of its equipment.

 

4. You will at all times maintain the property and its contents in the clean and tidy condition as you accept it at the start of your holiday. You will be liable to us for any loss, costs, expenses or claims arising from any damage caused to the property and its contents by you or any member of your party. You will be responsible for paying the reasonable cost of any repair or replacement caused by such damage.

 

5. You are only allowed to bring pets to the property which have been indicated as pets welome. No smoking of cigarettes, cigars or pipes is allowed in the property. We reserve the right to cancel your holiday and evict you from the property if these conditions are not observed.

 

6 .By making a telephone booking or online booking with deposit paid by credit/debit card you are deemed to have accepted these terms and conditions and you must ensure that all members of your party understand and comply with these terms.

 

7. In no circumstances may the number of people occupying the property exceed the number stated in the brochure and in the price list for the property. We reserve the right to refuse entry to the property and to terminate the agreement without notice if this condition is not observed. We may refuse to hand over the property to any person who we reasonably believe is not a suitable person to take charge of the property. We may also repossess the property if damage has been caused or we have a reasonable belief that damage will be caused. In such circumstances the rent for the property will be forfeit.

 

8. You must leave the property secure whenever you leave it unoccupied during your holiday.

 

9. You must ensure that no members of your party cause a nuisance or disturbance to people staying in surrounding properties.

 

10. You will allow us entry to the property at any reasonable time for reasonable purposes.

 

11. You must pay a deposit at the time of booking (or if the booking is made less than six weeks before the holiday start date, the full amount of the holiday). The deposit should be 25% of the full price shown for the holiday. You will receive confirmation of your booking by email once your deposit has been paid. You will then become liable for the balance of the rental, which must be paid six weeks prior to the start date of the holiday.

 

12. If you should cancel your holiday we will attempt to re-let the property for your holiday period, and if we are successful we will refund you any monies you have already paid to us in full. If we are unable to re-let the period, you must still pay us the full amount outstanding for your holiday. We therefore strongly recommend that you take out holiday cancellation insurance.

 

13. All rental prices include gas & electric.

 

14. If for any reason beyond our control we are unable to provide the property you have booked, then we will try to provide a similar or better one as replacement. If this is not possible, or if the alternative is not to your satisfaction, then we will refund all the monies you have paid in full. In any event we shall not be liable for any circumstances beyond our control (“force majuere”)

 

15. The description of our cottages in any brochures or marketing material including electronic material is accurate to the best of our knowledge, but small variations may occur from time to time as we try to make improvements. If you think the facilities are materially different to those described in our literature, then you should tell us immediately on arrival for your holiday and we will do our best to alleviate any problem caused.

 

16. You are responsible for any damage done by any member of your party.

 

17. These terms and conditions are severable so if any clause is deemed invalid or unenforceable then it shall be replaced as far as is possible by one having a similar meaning and purpose which is valid and enforceable. All other clauses shall remain in effect and unaltered by such a change.

 

18. Your statutory rights are not affected by this agreement.

 

19. This agreement is subject to Scottish Law as interpreted by the courts of Scotland.
